This past Monday, my wife and I went to Augusta to hear the debate before the Criminal Justice and Public Safety committee, regarding certain anti and pro- Second Amendment to the US Constitution and Article One Section 16 of the Maine State Constitution arguments. While we watched from the overflow room as the debate on LD 997, an act to establish restrictions on ammunition feeding devices, a bill I had not planned on speaking to, I heard one of the most asinine, ignorant comments I have ever heard spoken to the committee, and to my horror, not one member of the committee, Republican or Democrat chastised the speaker. What this ignorant, had to be a communist, said was to urge the committee to both put aside emotion and to ignore the Second Amendment.

Ladies and Gentlemen, there are certain absolute truths, an absolute truth being a truth that you do have to believe in for it to be truth, Examples of such are:

The sun will rise in the morning and set in the evening. You may not see it because of clouds, but it is there, the sun will rise in the morning and set at the end of day. You may not believe it but it is going to happen just the same. Another would be, "In the beginning God created the heavens and the earth." It does not matter if you believe it or not. You can, if you choose, believe in evolution, but what you believe or don't believe has no effect on the absolute truth that God did in deed create the heavens and the earth. It is an absolute truth.

Another absolute truth is that the Second Amendment to the US Constitution, A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. This is a simple sentence and is part of the US Constitution.

Another absolute truth is that Article one section 16 of the Constitution of the State of Maine states that Every citizen has a right to keep and bear arms and this right shall never be questioned.

Another absolute truth is that every member of the State Legislature, the governor, every chief of police, every office holder in the state of Maine has sworn an oath or affirmation to uphold both the US and the State Constitutions. Additionally, every member of Congress and the executive branch has sworn an oath or affirmation to uphold and not infringe upon the Constitution of the United States.

Just as when they took their marriage vows, which in reality is an oath or affirmation, they did not say that they would pledge their loyalty and fidelity except in the case of a good looking blonde with a come hither look. They swore to be faithful and loyal till death do them part. So also when those in office took the oath to uphold the Constitution, they did not take it exempting on the federal level A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. and on the state level Every citizen has a right to keep and bear arms and this right shall never be questioned.

How serious are these two parts to their respective Constitutions?

In 1987 the people of Maine amended Article one section 16 of the Maine State Constitution to read Every citizen has a right to keep and bear arms and this right shall never be questioned. It was changed from "Every citizen has the right to keep and bear arms for the common defense; and that right shall never be questioned." It was done because of abuses by the police in cities like Portland, Augusta, Windham and Biddeford, with the final straw coming when in 1986 the Maine State Supreme Court in State vs. Friel, ruled that the rights of Maine citizens to own guns, which had always been considered and understood to mean individuals, extended only to groups such as the National Guard. This caused such a fury that in a little more than a year, the Legislature had sent to the people the amendment to Article one Section 16, making it absolutely clear that the it was individual not corporate rights to possess guns.

In 1939, in Miller v US, the Supreme court ruled that the Militia was not the National Guard or the US military, but all individual men able to go to war. It further ruled that the weapons protected by the Second Amendment were those that were in common use by the Military.

First a little background... Mr. Miller was one of two men charged with possession of a sawed off shotgun, Mr Miller appealed based upon his Second Amendment right to bear arms as part of the Militia. Before the case came before the court, Mr. Miller very conveniently for the government, died. Yet even in this one sided case, the court ruled:

" The Constitution as originally adopted granted to the Congress power- 'To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions; To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress.' U.S.C.A.Const. art. 1, 8. With obvious purpose to assure the continuation and render possible the effectiveness of such forces the declaration and guarantee of the Second Amendment were made. It must be interpreted and applied with that end in view.

The Militia which the States were expected to maintain and train is set in contrast with Troops which they [307 U.S. 174, 179] were forbidden to keep without the consent of Congress. The sentiment of the time strongly disfavored standing armies; the common view was that adequate defense of country and laws could be secured through the Militia- civilians primarily, soldiers on occasion. "


"In the absence of any evidence tending to show that possession or use of a 'shotgun having a barrel of less than eighteen inches in length' at this time has some reasonable relationship to the preservation or efficiency of a well regulated militia, we cannot say that the Second Amendment guarantees the right to keep and bear such an instrument. Certainly it is not within judicial notice that this weapon is any part of the ordinary military equipment or that its use could contribute to the common defense. Aymette v. State of Tennessee, 2 Humph., Tenn., 154, 158. "

Those two excerpts from Miller v US make it perfectly clear that the Militia is not the National Guard and that the weapons protect by the Second are the weapons and equipment commonly used by the military.

It does not require one to be brilliant to know that High Capacity Magazines for both rifles and handguns are in common use by the US Military and are therefore covered and protected by the Second Amendment. In Maine you do not have to be a genius, only honest to know and understand that Article one section 16, Every citizen has a right to keep and bear arms and this right shall never be questioned is both a simple sentence that is part of the Constitution of the State of Maine and a prohibition on those taking an oath or affirmation to uphold the Constitution of the State of Maine to determine what weapon or weapons can be owned or to dictate magazine sizes and/or capacities.

You Ladies and Gentlemen that hold a position where you have sworn or affirmed to uphold either the Constitution of the United States or to both the Federal and your state Constitution, let me say this as clearly as I can:

If you are a mechanic and do not like having dirty hands, it is best to find another occupation.

If you are a surgeon and pass out at the sight of blood, it would be best for you to find another profession.

If you are a member of the Legislature, a member of the police, or one who has sworn to or affirmed to uphold the Constitution of the United States and/or your state Constitution and you cannot uphold 100% of it, then it is time for you to resign your position, for you are an oath breaker and to most minds, treasonous.

In closing let me state two more absolute facts. As for high capacity magazines, they are not high tech, as anyone with a metal break can make them. Also, It is not we the gun owners, the believers in the Constitutions as a whole that are the problem. It is not us that are the trouble makers, it is those wanting to disarm disarm us, the nation's last line of defense, that are causing the uproar, the problems. If we, the legitimate gun owners of the country, were 1% as vicious, as blood crazed, as irresponsible as those on the left claim, there would be none on the left. We have, since the early 1960's been vilified, lied about, blamed, and in every manner pushed and pushed and pushed, back and back. We have been tolerant, patient and willing to submit on more and more rules, regulations and restrictions, but there does not appear to be anymore room for us to back up to, for now our backs are starting to touch the wall.

In Proverbs 26, verse 11, God's word tells us another absolute truth, one we have seen over and over again with lie after lie, foolishness after foolishness, used to attack us by those who should know better: As a dog returneth to his vomit, so does a fool returneth to his folly. Source Links:
